One of the most important recognized by the Jones Act is the safety of the marine seeks to protect. The first is the OSHA (Occupational Safety and Health Administration). OSHA was created by Congress under the Security and Occupational Health, signed into force in 1970. OSHA's mission is to prevent occupational injuries, illnesses and deaths by issuing and enforcing safety standards at work and health. OSHA covers all workplaces in the private sector, and allows states to set standards for their public settings. However, OSHA is limited regulate within the jurisdiction extends to 3 miles offshore, and does not apply to working conditions are regulated by any other Federal organization.
The second of the agencies that regulate the maritime law is the U.S. Guard Coast. The Coast Guard has been a very influential body in the movement towards a maritime labor more secure. Coast Guard rules apply to Canadian vessels under the Jones Act, and are often the research unit when injuries occur. Coast Guard rules and regulations are essential to ensure that ships are properly equipped, monitored, and provide a safe working environment. Voluntary screening program are offered by the Coast Guard under the law of sea, where critical safety check and citations for deficiencies.
Although much has been achieved in safety standards aboard the vessels through these two federal agencies, injuries and deaths continue to occur. There are simply too many ships at sea, and also fewer resources available to inspect and enforce these regulations. The burden of security comes from the hand of the company or owner of maritime workers employed.
